Regular Council Meeting
June 4, 2007

The Regular Meeting of the Council of the City of Inkster, Wayne County, Michigan, assembled in the Council Chambers, 26215 Trowbridge, on Monday, May 21, 2007.

Call Meeting to Order

Pledge of Allegiance

Mayor Hilliard L. Hampton II called the meeting to order at 7:50 p.m. City Council and the public in attendance pledged allegiance to the flag of the United States of America.

Honorable Council Present:       Michael Canty, Wanda Harris-Foster, Ernest Hendricks, Marcus Hendricks, Ronald Johnson, Mayor Hilliard L. Hampton II

Honorable Council Excused:     DeArtriss Coleman-Richardson

Approval of Agenda

07-06-149       RESOLVED by Harris-Foster, seconded by Johnson to approve the agenda as presented with the addition of an Amendment to Ordinance 99. Nay: Johnson. MOTION CARRIED.

Public Hearing

Public Participation

·           Chief K.P. Enna – Auxiliary Police – Force has been addressing the basketball hoops with the issuance of 26 warning letters and one citation.

·           Michael Greene – Has concerns about campaigning at Memorial parade. Should be sacred. Proposes to invite family members of former soldiers.

·           Clarence Oden – Feels we should introduce the young ones to more cultural events. The ballet performance at the Simmons Center was excellent. The Inkster Golden Gate Lodge has been selected to host the Michigan Elk’s Convention, which is quite an honor.

·           Guy Borrush – Does not feel the library should be removed from the Wayne County System. Feels the Michigan Avenue/Middlebelt Road property should be sold for what it is worth. There is a traffic problem on Arlington.

·           John Donald – Does not feel the contractor is doing a good job on the grass and weeds in the city. Who supervises the contractor? Rieven Holt stated the concerns would be addressed.

·           Terry Johnson – Has concerns with campaigning during the Memorial Parade. Asked the Mayor to created an ordinance to respect Memorial Day.

·           Arnell Johnson – 3582 Harrison was placed on the demolition list in error. Was allowed to perform work in the amount of $7,000. It should be taken off immediately so he can resume his work.

·           Willie Johnson – Feels the people need to be assisted to own more businesses. There are street lights out throughout the city and abandoned homes.

·           Hardy Robb – Concerned with decay in the city. Investors should be held accountable to continue to improve and maintain properties. Does not feel citizens are well informed of city events.

Mayor and Council Concerns

·            Harris-Foster: A home at Middlebelt and Andover has high shrubbery. Home on Andover needs to be cleaned. Patrol needs to be increased at Glenwood and Parkwood.

·            E. Hendricks: Tree trimming in the southeast section is neglected.

·            Canty: Thanked Police Department for responding to Watch Group.

·            M. Hendricks: Stated Public Hearings have been held to address gas stations. Voice tree trimming concerns. Would like to see police patrols increased. Water rates are being lowered in other communities by asking citizens to decrease water usage during the time Detroit uses to gauge its rates.

·            Johnson: Announced the Florence Street Block Club meets on the 4th Saturday of each month at the Police Auxiliary building.

·            Mayor Hampton: Announced there is a play at the Inkster High School Friday and Saturday.

       Consent Agenda

07-06-150.   RESOLVED by Harris-Foster, seconded by E. Hendricks to approve minutes from the regular council meeting of May 21, 2007, Police and Fire Retirement System for the month of May in the amount of $138,555.51 to be paid on May 31, 2007 and Police and Fire Retirement System for the month of May in the amount of $138,555.51 to be paid on June 30, 2007. MOTION CARRIED

City Clerk

Stated to Mayor and Council and the citizens of Inkster that the last day to register for the August 7th Primary Election is July 9th. The Primary will be held in the First, Third and Sixth Districts only.

07-06-151    RESOLVED by Harris-Foster, seconded by M. Hendricks to allow the City Clerk to attend the Michigan Association of Municipal Clerks Annual Convention from June 26 – June 29, 2007 at a cost of $664.00. MOTION CARRIED

       Boards and Commissions

        Mayor asked for an updated Boards and Commissions list.

  Councilman Johnson stated the Boards and Commissions should be submitting reports to the City Clerk.

       Second Readings

  07-06-152  RESOLVED by E. Hendricks, seconded by Johnson to approve an ordinance to amend section 155.048 (c) of the code of ordinances of the City of Inkster entitled Uses Permitted Subject to Special Conditions. MOTION CARRIED.

07-06-153    RESOLVED by E. Hendricks, seconded by Harris-Foster to approve an ordinance to amend section 155.110 of the code of ordinances of the City of Inkster entitled Special Conditions and Land Use Standards, by adding a new section 155.143 entitled Special Conditions for the Processing of Bio Diesel Fuels with the addition of language to be submitted by the City Attorney and be made part of the resolution. Nay: Johnson. MOTION CARRIED.

                     Discussion arose when Dr. LaTina Dawkins, Planning and Economic Director brought to the Council’s attention that all conditions had to be identified at the time of council approval. Council feels this information should have been discussed prior to the first reading of the ordinance. It should state this is a 302 site special use variance to operate in the city and that animal by-products not be used as a catalyst. Councilman Johnson stated there should be a 200-foot set back and the employment and education component is added to the language.

       City Manager

Requested Council to select a date for City Hall dedication. The dates to consider are 06/23, 06/30 from11:00 a.m. to 1:00 p.m. or 06/28 from 6:00 to 8:00 p.m.

The Mayor acknowledged The City Seal placed in the Council meeting room and all parties that were involved were commended. As well as the illuminated sign in front of the building.

       New Business

07-06-154    RESOLVED by Canty, seconded by E. Hendricks to approve the Second Amended Downtown Development Authority (DDA) Tax Increment Financing Plan. MOTION CARRIED

07-06-155    RESOLVED by E. Hendricks, seconded by Canty to authorize administration to apply for an annual permit from Wayne County to construct, operate, use/or maintain and to occupy the right of way of Wayne County roads. MOTION CARRIED

07-06-156.   RESOLVED by M. Hendricks, seconded by Harris-Foster to approve Intergovernmental Agreement between the City of Inkster and County of Wayne for the 2007 Justice Assistance Grant (JAG). MOTION CARRIED

07-06-157.   RESOLVED by Harris-Foster, seconded by Johnson to amend the City of Inkster’s 2006/2007 Budget as presented. MOTION CARRIED

07-06-158.   RESOLVED by Harris-Foster, seconded by E. Hendricks to amend the City of Inkster’s 2006/2007 Budget to recognize a potential lag in the timing of forfeiture funds. MOTION CARRIED

07-06-159.   RESOLVED by Johnson, seconded by M. Hendricks to award Spectron Denken Electric an amount of $13, 390.00 with a contingency of $1,339.00 (10%) for the purchase/installation/repair of parking lot lights poles at the recreation complex based on quotations received. MOTION CARRIED

07-06-160.   RESOLVED by E. Hendricks, seconded by Harris-Foster to award bid to Better Hardwood Floors in the amount of $14,050.00 to sand and refinish and stripe the gymnasium floor and a racquetball court at the recreation complex. MOTION CARRIED

07-06-161.   RESOLVED by Harris-Foster, seconded by M. Hendricks to award Engan-Tooley-Doyle and Associates an amount of $9,840.00 for the purchase /shipping/ installation of a slide for the swimming pool at the recreation complex. MOTION CARRIED

07-06-162.   RESOLVED by Johnson, seconded by Canty to authorize change order #1, in the amount of $32,000.00, to the contract awarded to Cadillac Asphalt Co. for the reconstruction of the parking lot at 26215 Trowbridge for additional work. MOTION CARRIED

Councilman Johnson and Councilwoman Harris-Foster objected to the Housing item being placed on the agenda because there was no representation from the Housing Commission present. The terminology used to place the item on the agenda was incorrect, leading Councilman Johnson to protest and challenge the Chair. The Chair deemed Councilman Johnson out of order. Discussion arose regarding the term “reconsider” being used by Councilman Canty to place the item on the agenda. Robert’s Rules was examined and a decision was made that the item could only be reconsidered on the next business day. However, because of the time lapse since the item was last placed on the agenda, it could be placed on the agenda as a new item. City Clerk will pull the information from the August 7th and August 21st meeting for clarification.

07-06-163.   RESOLVED by Canty, seconded by E. Hendricks to approve the First Reading of an amendment to Ordinance 99 as it relates to Inkster Housing Commission. Stating the Inkster Housing Commission is authorized to act as a borrower for the purposes of issuing bonds or notes in accordance with the provision of Act 18 of the Public Acts of 1933, Extra Session, as amended.” Nay: Johnson. MOTION CARRIED

Moved by Canty, seconded by M. Hendricks to go into closed executive session at 9:45 p.m. to discuss contract negotiations, pending litigation and attorney client privilege, in accordance with MCLA 15.268

Moved by Canty, seconded by Harris-Foster to return to Open Session at 10:13 p.m.

Discussion continued regarding the motion to approve the first reading of Ordinance 99. The Clerk stated according to Robert’s Rules it is acceptable to approve the ordinance as a First Reading. The language used to “reconsider” was improper but would not exclude the item from being approved. A Parliamentarian will be consulted and the City Clerk will report back to Council.

 

       There being no further business to come before Council, on motion duly made by Canty and seconded by Harris-Foster and carried, the Regular Council Meeting of June 4, 2007 was adjourned at 10:15 p.m.
